Condemn Malkangiri encounters! Halt the war on our own citizens!

PUCL expresses its strongest sense of outrage and condemnation for the killing of about 39 members of the CPI (Maoist) party and other Adivasis near Balimela reservoir in Malkangiri district of Odisha close to the Odisha – AP border on 24th October, 2016.  Though the police claim that the killings were a result of a sudden encounter and resultant fire-fight, all the available circumstantial information indicates that there is sufficient ground to disbelieve the story put forth by the police and Government. All the tell tale signs of a false encounter killing lend weight to the allegation that many of the killed Maoist leaders were actually apprehended previously, shot in cold blood and a fake encounter episode fabricated to explain the killing of all persons allegedly involved. Torture marks are also said to have been seen on the bodies of those killed.

This incident raises yet again substantiates very worrying trends noticed in the response of security forces in conflict areas:

  1. Politics of annihilation, capturing no militants: Subversion of Criminal Justice System

A noticeable feature of this encounter killing, as in many other recent killings, is that the security forces end up eliminating or killing all members of the alleged militant group claiming that there was no alternative. Such practice of eliminating all militants is resorted to leave no eye witnesses to the fake encounter alive. This unbridled power exercised by the security forces with the connivance / complicity of the State or Government has substantially criminalised the security forces dealing a death blow to the rule of law and criminal justice system.

  1. Police Impunity, lack of accountability of security forces and Complicity of State – Failure of Constitutional governance:

The Malkangiri killings  once again strongly points out to the sense of impunity and the lack of accountability with which the security forces operate in the country. Very disturbing is the role of the State or Government in ensuring strict compliance with the Indian constitution on the part of the security forces lending weight to the allegation that they are complicit with the subversion of rule of law and constitutional governance.

            The latest proof of state complicity in lawlessness of security forces and the false staging of encounters and actual commission of violence against uninvolved villagers came in the Supreme Court when in October, 2016, the CBI filed a chargesheet in  the Tadmetla arson case (of 2011 in Chhattisgarh) implicating 323 Special Police Officers (SPOs) / Policemen as well as 114 personnel of COBRA and 30 personnel of CRPF as having participated in operations in Morpalli, Tadmetla and Timapuram villages of Chhattisgarh resulting in the killing of 3 men, rape of 3 women and burning down of over 250 houses between 11th to 16th March, 20111 and attack of Swami Agnivesh when he went to deliver relief supplies on 26th March, 2011.   The police and Chhattisgarh government had in 2011 strongly refuted involvement of security forces in violence on villagers and instead continuously alleged that it was the Maoists and villagers themselves who had burnt down the houses.

The truth has been exposed now thanks to the independent investigation by the CBI having been ordered by the Supreme Court of India into the Tadmetla incidents. It will be useful to note that the CBI investigating team itself met serious threats and intimidation from the state police while completing investigations.

PUCL demands that the guidelines given by the Supreme Court in `People’s Union for Civil Liberties vs State of Maharashtra’ case (2014) should be enforced without exception. The mandate of law requires that in every instance of encounter killings a FIR has to be registered and investigated by independent police agency.

 Considering that the Special Police forces of the 2 states, Odisha and AP,  have been involved in the alleged encounters and the continuing allegation that the state governments in both states have supported and ensured impunity and immunity enjoyed by the police from investigation, there are enough grounds to feel that independent, impartial and credible investigation cannot be done by the police forces themselves into the encounters.

PUCL therefore demands:

(i)    that a Judicial enquiry be initiated headed by a sitting Supreme Court or High Court judge into the killings so that the truth of the killings can be brought to light.

(ii)  A FIR should be registered into the encounter killings, providing the names of all security personnel involved, as required by the SC judgment in PUCL Case 2014.

(iii)         The Government of AP and the AP State Police should comply with the Orders passed by the AP High Court on 31st October, 2016, to immediately produce before the Court,  Ramakrishna @ Akkiraju Hargopal @ AK, Gaajarla Ravi and 9 others who are supposed to be in the custody of the AP Police since the 24th October incident and ensure that their personal safety, life and well being are protected.

In India more than 10.000 political prisoners are languishing in jails. They are leaders, cadres and members of the COI (Maoist) and PLGA; Adivasi villagers who resisted the forced evacuation; peasants who struggled against the MOUs signed by governments and TNCs to exploit the people and continue the imperialist looting of natural resources; activists of the national minorities organized against the rising threat of Hindu communal fascism; intellectuals as Dr Saibaba, artists, students and activists other democratic organizations, guilty of standing on the side of the people facing the war on people waged by the Indian state; people’s women, feminists, united to rebel against the huge escalation of rapes, committed in part by the armed and police forces and paramilitary fascist squads sponsored by the State. In jails the prisoners face every kind of harassment, torture, denial of bails, inhumane living conditions, arbitrary transfers, brutal assaults and punishments of solitary confinement, and often the detained women are raped.
In spite of the fierce condition of detention, prisoners are resisting and struggling with revolutionary spirit and turning the dark jails in which are confined into a battlefront against the raising fascism in India and the Indian regime.

The struggle for their unconditional release is an urgent task for all the solidarity forces and it is integrant part of the support for the victory of their liberation war.

All India is more and more turned by the ruling classes into a “prison house of people’s movements”. The Indian ruling classes, under the guidance and with the assistance of imperialists, launched the multi-pronged and country-wide offensive called Operation Green Hunt. This is supposed aimed to wipe out the Maoist movement but it is in fact it targets and is aimed to suppress any genuine democratic demand of the people. Thousands of revolutionary and democratic mass organizations leaders and members have been assassinated, tortured and put in jails. Blamed under false cases, many of them are facing harsh punishments, under the draconian laws adopted by the central and state governments, that brand people’s leaders and strugglers as ‘anti-national or terrorists’
Imperialist economic and financial crisis is intensifying continuously and also the imperialist aggressions and reactionary wars intensify. In this situation, the Modi’s brahmanical fascist BJP government have given top priority in their agenda to annihilate at the earliest the Maoist struggle, the newly shaping people’s political power organs, the Krantikari Janatana Sarkar (Revolutionary People’s Committees) and to plunder country’s natural wealth at a speedy pace at any cost. Modi, who is the first servant of domestic and foreign Corporate Houses, has not only initiated but is also aggressively implementing the third phase of Operation Green Hunt. In this context, Modi’s regime proposed aerial attacks on Adivasi areas.
Indian Maoists appeal all revolutionary parties and organizations, international solidarity organizations, trade unions, renowned democratic progressive intellectuals, workers, peasants, students, youth, artists, writers, scientists, environmentalists, teachers, to raise their voice against the decision of aerial attacks on adivasi majority areas and to take to streets in protest.
The liberation war of the masses in India cannot be stopped by the savage repression, rather it extends the political and moral solidarity to the people’s war.
The International Committee in Support of the People’s War in India launches an International Week of Action a from 2nd to 9th of April 2016 all around the world.
In this week all initiatives will express solidarity with all political prisoners in the jails of imperialism and reactionary regimes and support to all struggles for their liberation.

බ්ලොක් රූජ් (මාඕවාදී එක්සත්කම) සහ මාඕවාදී ඉතාලි කොමියුනිස්ට් පක්ෂය විසින් සංවිධානය කරනු ලැබූ ජාත්‍යන්තර හමුව නොවැම්බර් 21, සෙනසුරාදා දින පවත්වන ලදි: ‘‘බෑන්ලියස් කැරැල්ලේ සිට නිර්ධන පංති විප්ලවය දක්වා!’’ බෑන්ලියස් කැරැල්ලේ දස වන සංවත්සරය අවුබවිලියස් වල පැවැත්වුණ අතර කැරැල්ල ඇරඹුනේ 2005 නොවැම්බර් හි දීය. මේ රැස්වීම අතිශය දුෂ්කර තත්ත්වයන් යටතේ පවත්වන ලදි.

පළමුවෙන්ම, මේ රැස්වීම සිදු නොවන තැනට වැඩ සැලසීමට පොලිස් පීඩනය යෙදිණි, මෙය අවුබවිලියර්ස් හි දී අපේ සහෝදරවරුන්ට හිංසා පීඩා කිරීමෙන් ක‍්‍රියාත්මක කෙරිණි. නොවැම්බර් 13 කෲර ඝාතනයෙන් පසු රජය හදිසි නීතිය පැනවීමෙන් පසු තත්ත්වය තවත් දුෂ්කර විය. ඒ වන විටත් නියම ස්ථානය දැනුම් දී තිබියදී ත් (සිය ගණන් පෝස්ටර් ඇලවිණි, දහස් ගණන් අත් පත‍්‍රිකා බෙදා හැරිණි) ස්ථානය වෙනස් කිරීමට අපට බල කෙරිණි.

මෙ සියල්ලටම රැස්වීම වැළැක්වීමට නොහැකි විය, එය සාර්ථකව අවසන් විය! ස්ථානය වෙනස් කොට තිබිය දී පවා, නව ශාලාව පිරී තිබුණි, අනෙකුත් රටවල්වල සහෝදරවරුන් විසින් එවන ලද සියළු ප‍්‍රකාශන කියවන ලදි. සියළුම ප‍්‍රකාශන සහ පණිවිඩ එකට එක් කොට පොත් පිංචක් ලෙස ප‍්‍රංශ, ඉතාලි සහ ඉංග‍්‍රීසි යන භාෂා වලින් පළ කෙරෙනු ඇත.

සමාප්තියෙදී යොමු වුනේ මේ රැස්වීම හුදෙක් සිදුවීමක් නොව, ඊට ප‍්‍රතිලෝමව දිගින් දිගටම ගෙන යා යුතු සහ විස්තීර්ණ කළ යුතු ක‍්‍රියාවලියක් වශයෙනි. අධිරාජ්‍යවාදී රටවල මහජන යුද්ධය පිළිබඳ ප‍්‍රශ්නයේ දී දිළිඳු නගරාන්ත ප‍්‍රදේශ තුළට තවදුරටත් ඇතුල් විය යුතු බව මෙහිදී සටහන් කෙරුණි.

රාජ්‍ය හදිසි නීතිය යටතේ, පැරීසියේ දී, යුරෝපයේ විවිධ රටවලින් පැමිණි මාඕවාදීහු සහ අධිරාජ්‍යවාදීන් විසින් පීඩාවට පත් කෙරෙන රටවල් වල පක්ෂ සහ සංවිධාන වල සහයෝගය ඇතිව සහ අනෙකුත් අධිරාජ්‍ය විරෝධී බලවේග වල පැමිණීමෙන්, කොවැම්බර් 15 ඩයිච් හි ප‍්‍රතිගාමී ප‍්‍රහාරය නිසා ඇති වූ තත්ත්වයට අභියෝග කරමින් විප්ලවීය රැස්වීමක් පවත්වන ලදි.

සටන්කාමී සහ කලහකාරී පසුබිමක් තුළ, 2005 වසරේ බෑන්ලියස් හිදී තරුණ ජනයා සහ නිර්ධනීන් කැරලි ගැසීම ආචාරයට ලක් කෙරුණු අතර එහි ඓතිහාසික වැදගත්කම නැවත ව්‍යාප්ත කෙරුණි, විශ්ලේෂණය ට ලක් කෙරුණි.

මාඕවාදීහු මැද පෙරදිග අධිරාජ්‍යවාදී යුද්ධ වලට සහ, ප‍්‍රංශයේ සහ අනෙකුත් රටවල්වල රාජ්‍ය හදිසි නීති වලට විරුද්ධ වන අතර ඔවුහු පැරීසියේ බෑන්ලියස් පොදු ජන අරගලයේ දී ද තරුණයන්ගේ පැත්ත ගන්නා බව උස් හඬින් කිව යුතුය.

සහභාගි වූ බලවේග, අධිරාජ්‍යවාදීන් සහ ඔවුන්ගේ යුද්ධ සමග සටන් කිරීමේ දී සිය වගකීම් ගැනීමට සූදානම් බවත්, සියළු අධිරාජ්‍ය විරෝධී මහජන අරගලවලට සහය දෙන බවත් මහජන යුද්ධයේ විශ්වනීයත්වය තරයේ ප‍්‍රකාශ කරන බවත් සඳහන් කළහ.

රැස්වීමේ සියළු කථා ඇතුළත් පොත් පිංච, සියළු විප්ලවවාදීන්, අධිරාජ්‍ය-විරෝධීන්, කොමියුනිස්ට් සහ මාඕවාදී බලවේග වලට සිය විප්ලවීය භාවිතාවත් සමග දිගටම සාකච්ඡාවක් ගෙන යාමට ඉඩ හැරිය යුතු බැවින් ඉදිරි සති වලදී ඉංග‍්‍රීසි, ප‍්‍රංශ සහ ඉතාලි බසින් පළ කෙරෙනු ඇත.

ATS adds statements of ‘sympathisers’ to make a strong case against ‘Naxal’ leader
THE Anti-Terrorism Squad (ATS), which is likely to file a chargesheet against alleged Naxal ideologue K Muralidharan, has included the statements of suspected ‘sympathisers’ who were persuaded by Muralidharan to join the Naxal stir. The counter-terrorism agency is likely to file a chargesheet against Muralidharan in the coming week under certain sections of the Unlawful Activities Prevention Act (UAPA) and the Indian Penal Code( IPC).
In May, the ATS arrested top Maoist leader K Muralidharan alias Thomas Joseph alias Skaria alias Gopi alias Raghavan alias Ajith (62) and his aide Ismail Hamaza Chiragpilli alias Pravin alias James Mathew (29) from Talegaon Dabhade area, about 30 kms from Pune. In May 2014, Muralidharan, the national secretary of CPI(ML) Naxalbari, had merged his party with the CPI(Maoist) and was made the central committee member. After becoming a central committee member, Muralidharan was assigned the task to strengthen the outfit’s base in Pune and was therefore camping in Talegaon to scout for new members, the ATS claims.
To assert this claim, the agency has included the statements of over a dozen people from Pune, mainly comprising college students and businessmen. Sources claim that in 2014, these people, who are now witnesses, were approached by Muralidharan to join the outfit. “With the help of the absconding accused, Sanjay Deepak Rao (51), who allegedly provided logistic support, Muralidharan set up his base in Talegaon. He was able to approach a few and was in the process of ‘brainwashing’ them,” a senior official said.
“The witnesses have narrated the accounts in which they were persuaded to join,” added the officer. “A base in Pune was a part of the larger plan to expand their activities in the Western Ghats,” the official added. The police claim that other than the statements, they have recovered alleged ‘Naxal literature’, mostly in Marathi, English and Malayalam, and fake adhaar and PAN cards from the Talegaon safe house. In its chargesheet, the ATS will mention the new hideouts of the outfit, especially those in the central forest.
It will also throw light on the meetings between Muralidharan and alleged top Naxal leader Muppalla Lakshmana Rao alias Ganapathy. “Muralidharan has shared details of the treacherous travel he had to undertake to meet the man on whom there is a bounty of Rs 2.5 crore. Ganapathy, the general secretary of the CPI(Maoist) touted as the topmost Naxal leader in the country,” said an officer. Sources say Muralidharan has told investigators that the process of meeting Ganapathy would commence with a human courier suddenly landing up at his doorstep and passing on the message to get on to a train to a particular state and meet another courier at a certain place.

The human courier and Muralidharan would board a state-run bus and alight in an interior village. Soon, the courier would blindfold him and they would walk straight for two days. After his blindfolds would come off, Muralidharan could only see tall trees on all sides. He would then undertake another two-day journey though the forest to finally reach a ‘safe house’ where Ganapathy would meet him. “Other than the elaborate travels, the only detail he has shared are the names of the states such as Bengal, Madhya Pradesh, Karnataka where he has travelled to meet him,” said the officer.

COMMITTEE FOR THE RELEASE OF POLITICAL PRISONERS 

As confirmed by the newspapers and further affirmed by civil rights activists, Maoist intellectual and writer Mr. K. Murali and another activist Mr. CP Ismail are shown arrested by the Maharashtra ATS in Pune allegedly from a housing colony. But contrary to the news paper reports, civil libertarians confirm that Mr. K Murali was undergoing treatment in one of the hospitals in Pune and was detained from there. Whatever one could decipher from the little exchange that he had with the media, it is clear that Mr. K Murali, a senior citizen (62) was arrested while he was undergoing treatment. CP Ismail is 29 years old. The date of the arrest is still not clear though it is reported that the ATS arrested him on Friday and then produced him before the court to be remanded in police custody for the next 7 days.

It is a matter of grave concern that Mr. Murali who is a heart patient and had undergone a heart surgery before is not being allowed to be treated. Rather the court has left him in police custody where there is every possibility that his health can further deteriorate. In the mean time, Murali and Ismail have so far not been allowed to reach out to their lawyers. Like every other political prisoner normally slapped with the draconian UAPA, Mr. Murali and Mr. Ismail will be no exception to the lawful lawlessness of this worst ever legislation which proves the burden of proof on the accused while leaving ample space for the police to indulging every kind of impunity. In such a scenario it is highly unlikely that the police will let him to undertake his medical treatment.

We demand that Mr. Murali be allowed to continue with his medical treatment for which he had got admitted in the hospital. As a Maoist intellectual K. Murali is the author of many books and articles on the politico-economic and historic trajectories that contributed to the constitution of the social formation that is Kerala. His most discussed work is Land, Caste and Bondage (Bhoomi, Jati, Bandhanam) in Malayalam. He was the editor of ‘A World to Win’ and ‘Massline’ two theoretical and political magazines that analyzed the local and international scenario from a Maoist perspective. We at the CRPP demand that the right to silence and right to a lawyer of their choice be met with and their fundamental right to safeguard them from being tortured be ensured.

We further demand unequivocally that the place for such social and political thinkers who through their keen observations and interventions have enriched and expanded the horizon of the debates on issues that are central to the present and future of the vast sections of the people in Kerala and the subcontinent cannot be in the dungeons. They should be allowed to express their views and opinions freely, not only as a fundamental right of their freedom of expression, but also for the deepening of the democracy that we claim ourselves to be.

Release K. Murali and CP Ismail immediately and unconditionally! 
Repeal the draconian UAPA and all other anti-people laws!
