අපේ නීතිඥයින් ඉක්මනින්ම ඉහළ උසාවිය කරා යොමුවනු ඇත. මේ තීන්දුව කම්පනයක් ඇති කරයි. සියළුම පුද්ගලයින්ගේ චෝදනා පත‍්‍ර මගින් සහ සෑම කොටසකින්ම ජීවිතාන්තය දක්වා සිර දඬුවවමකට වැරදිකරු කළ මහාරාෂ්ට‍්‍රා ඉතිහාසයේ පළමු නඩු තීන්දුව මෙයයි. සායිබබාගේ සහෝදරයා ගරු අධිකරණය ඉදිරියේ අපේ නීතිඥයින්ගේ තර්ක කිරීම් බොහොමයකට පැමිණියද විනිශ්චය විසින් ඒවා කෙරෙහි කිසිදු සැලකිල්ලක් නොදක්වා තිබුණු බව සොයා ගැණුණි. පැමිණිල්ල මගින් කිසිදු සාක්ෂියක් සනාථ කොට නැත. ඉලෙක්ට්‍රොනික සාක්ෂි මුද්‍රා තබා නැත. එය මගින් පෙන්වන්නේ ප‍්‍රාන්ත සහ මධ්‍යම රජය සංස්ථා සහ ආකර කොම්පැනි වල නියමයන්ට යටත් වෙමින් ජනතා විරෝධී සහ ප‍්‍රජාතන්ත‍්‍ර විරෝධී ප‍්‍රතිපත්ති ක‍්‍රියාවට නැංවීමට අධිකරණයට දැවැන්ත පීඩනයක් එල්ල කරන බවයි. රජය මේ රටේ සම්පත් කොල්ලකෑමට වාරණාත්මක ලෙස ජනතාවගේ හඬ මැඩ පවත්වයි. සායිබබා වැනි මිනිසුන් පසේකට තල්ලූ කොට බීජේපී රජයට ආර්එස්එස් න්‍යාය පත‍්‍රය නිරුවත් ලෙස ඉදිරියට තල්ලූ කරන්නට අවශ්‍ය කරයි.

රජය අධිකකරණය හරහා මෙම නඩුව තෝරා ගත්තේ ආචාර්ය සායිබබාගේ හඬ නිහඬ කිරීමටයි. උසාවියට ගරු කරමින් සායිබබා මේ සෑම වර්ෂයකම සහ අද පවා සිය පිරිහුණු සෞඛ්‍ය තත්ත්වය නොතකා උසාවියට පැමිණියහ. බිරිඳක් ලෙස මම යුක්තිය අපේක්ෂාවෙන් ඉහළ උසාවියේදී සටන් තුළ සටන් කරන්නෙමි. රජය දිල්ලිවල මගේ නිවස වට කිරීමෙන් පසුගිය සිව් වසර පුරාම නිර්දය පීඩනයක් පවුල වෙත එල්ල කළහ. මම ප‍්‍රජාතන්ත‍්‍රවාදීන්ගෙන්, ජනතා සංවිධානවලින්, බුද්ධිමතුන්ගෙන්, ශිෂ්‍යයින්ගෙන් රජයේ මේ විදියේ ප‍්‍රජාතන්ත‍්‍රවිරෝධී භූමිකාව හෙලා දකින ලෙස ඉල්ලා සිටිමි. තීන්දුව ප‍්‍රකාශ කිරීමෙන් පසුව, අධිකරණය අපේ නීතිඥයින්ගේ අභියාචනය මත කිසිදු නියෝගයක් නිකුත් කිරීම ප‍්‍රතික්ෂේප කළහ. නීතිඥයින් විසින් අවශ්‍ය ඖෂධ ලබා දීමට, සායිබබා ව්‍යාපාරයට අවශ්‍ය සහයෝගය ලබා දීමට, පිත්තාශය හා සම්බන්ධ සැත්කම සිදු කිරීම යනාදී දේවල් සඳහා බන්ධනාගාර අධිකාරියට නියෝග කරන ලෙස අධිකරණය මගින් ඉල්ලනු ලැබිණි. සායිබබා පරීක්ෂණ යටතේ සිරගතකොට තිබෙන අතරවාරයේදී පවා ඔහුට ලැබිය යුතු අවම අවශ්‍යතා ලබා දීමටවත් උසාවිය මගින් කටයුතු නොකරන ලදි.

The Gadchiroli sessions court today granted life imprisonment to Delhi University professor G N Saibaba, a JNU student and three other convicts in connection with their Maoist links. One convict Vijay Tirki got 10-years jail.

Earlier in the day, the six accused were convicted by the Gadchiroli court for their alleged links with Maoists and their involvement in anti-India activities.

Along with DU professor Saibaba, JNU student Hem Mishra, former journalist Prashant Rahi and three others have been convicted for Maoist links. The Gadchiroli court announced the punishment at 3 pm today. The other three convicts are couriers Mahesh Tirki, Pandu Narote and Vijay Tirki.

The court found Saibaba and five others guilty of waging a war against India. Saibaba was a professor at Delhi University’s Ram Lal Anand College. According to The Indian Express, Judge SS Shinde convicted the accused under sections 13, 18, 20, 38 and 39 of the Unlawful Activities (Prevention) Act.

Earlier, prosecution lawyer Prashant Sathianathan had demanded life imprisonment under section 20 of the Act for the accused. He also that Saibaba shouldn’t get any reprieve, even as he is disabled and wheelchair-bound. The prosecution argued that his handicap didn’t stop him from aiding and abetting activities that claimed several lives. Saibaba was out on bail since June last year.

Mishra and Rahi were first arrested in August and September 2013 from Aheri and Chhattisgarh respectively, according to police. Saibaba was arrested on May 9, 2014 from his residence in Delhi on the basis of the alleged incriminating material recovered from the two. The police claimed they had recovered documents, hard disks and pen drives.

During the argument in court in November, the prosecution said that the prosecution of the accused was being done as per the rules. “We told the court that the sanction was secured from the state government after submission of documents and material that establish the complicity of the three accused in the activities furthering the cause of the banned organization,” Prashant Sathiyanathan, Special Public Prosecutor, had told The Indian Express.

Defend the rights of Dr. GN Saibaba, demand his immediate release – International League of Peoples’ Struggle

We, the International League of Peoples’ Struggle, resolutely and vigorously support the campaign for the defense and release of Dr. G N Saibaba from prison. We condemn the grave violation of his civil and political rights, especially his right to free speech and his rights against unjust imprisonment, physical and mental torture and cruel and inhumane treatment. We base ourselves on the reports from Indian human rights organizations and we hereunder restate the facts of his case for the purpose of wider dissemination.

Dr. G N Saibaba was at first abducted on 9th May 2014 from the Delhi University North Campus by the Maharashtra police. Because of his strong principled and vocal opposition to Operation Green Hunt, as a military campaign to oppress and exploit the Adivasis (indigenous people) and to grab their natural resources, he was framed as a Maoist and charged under the vicious UAPA legislation. He was imprisoned in the Nagpur Central Jail for over a year.

Dr. Saibaba was then already 90% disabled and wheel chair bound, unable to walk. He was put in solitary confinement in the notorious anda cell and consequently became afflicted with problems in his spinal cord. These were followed by complications in heart, kidney and gall bladder. His left arm became completely paralyzed owing to gradual muscle atrophy.

The prison authorities acting under the Central Government command were hell bent on killing Saibaba in prison. But a concerted campaign of democratic and human rights activists and associations in India and abroad brought public opinion to bear on the Indian authorities and pressed them to release Dr. Saibaba on bail for medical treatment. The Indian High Court granted Dr. Saibaba three months bail for this purpose on 30 June 2015.

Dr. Saibaba received treatment at various hospitals in Delhi. His application for a permanent bail was rejected by the Nagpur Bench of the Bombay High Court. But upon the recommendation of the doctors treating him, he was able to get his bail period extended by a further three months. Then, on 23 December 2015 a single judge from the same Court ordered Dr. Saibaba to surrender himself to the Nagpur prison within 48 hours. This order ignores Dr. Saibaba’s serious ill health and the previous Court Order that allowed him at least until 31st December 2015 to receive medical treatment.

We fully agree with all the defenders of Dr. Saibaba that the order to put him back in Nagpur jail is a barbaric act by the Indian state, completely unmindful of his grave disability and ill health. As if on a rampage, the same High Court judgement has also ordered proceedings for criminal contempt against highly respected writer and social activist Arundhati Roy for her article, titled ‘Professor, POW’, against GN Saibaba’s unjust imprisonment and violation of his right to free speech. It is criminally absurd that a court engages in a chain of acts against the fundamental freedom of speech that is supposed to be guaranteed by the Indian Constitution.

Having known Dr. Saibaba as a colleague in the ILPS since its founding in 2001, we are proud of his record of standing up and speaking against the neoliberal policy of imperialist globalization and the consequent recurrence of crisis and the escalation of imperialist plunder and war. We are proud of his principled and courageous stand against the Indian government’s pseudo-development programs that are designed to let multinational corporations grab vast areas of land and loot the mineral wealth of the India. Dr. Saibaba has exposed the fact this pseudo-development benefits the exploiting classes at the expense of the Adivasis who lose their homes, land, water and forests.

The Adivasis are driven by the imperialists and the Indian reactionaries to engage in a life and death struggle against the State in order to uphold and defend their ancestral rights and preserve their environment. They are fighting heroically against such military operations as Operation Green Hunt which are unleashed by the reactionary armed forces. Dr. Saibaba has stood for justice in opposing the crimes being committed against the Adivasis. We are outraged that he is made to suffer for speaking out his mind for the cause of justice. We are also indignant that the state is persecuting Arundhati Roy just because she has criticized the Court’s decision to deny Dr. Saibaba permanent bail.

We call on all member-organizations of the International League of Peoples’ Struggle to issue statements and undertake protest actions before Indian embassies and consulates to condemn the unjust acts of the Indian authorities and to demand the permanent bail and immediate release of Dr. G N Saibaba and thus allow him to get the proper medical care and treatment. We must also demand the withdrawal of the false and outrageous charge of contempt against Arundhati Roy for defending Dr. Saibaba’s right to free speech.

India: Protests rise against jailing of G. N. Saibaba

 
26 May 2014. A World to Win News Service. India has seen a rising chorus of protests against the imprisonment of G. N. Saibaba, an associate professor of English at Delhi University and long-time activist in the Indian people’s movement.
 
A team of police in civilian clothing stopped his car on 9 May, as he was returning to his university residence for lunch after exam duty. Saibaba, 47, is 90 percent disabled and uses a wheelchair. He and his driver were blindfolded and hustled into an unmarked vehicle. He was immediately taken to the airport and flown to Nagpur in the state of Maharashtra, where he was brought before a court the next day.
 
Saibaba’s wife said that all she knew was that he suddenly disappeared shortly after calling her, and then his phone was turned off. The driver was not released until that evening. In the afternoon his wife received a phone call, but there was no official notification or word about his fate until he was presented in court the next day, after she filed a missing person report and outrage at his apparent disappearance had begun to mount. She accused the authorities of arresting him in this furtive manner to prevent anyone from notifying his lawyers before he could be taken to Nagur, where charges had been filed against him under the Illegal Activities Prevention Act for alleged contacts with a banned organization, the Communist Party of India (Maoist).
 
The Nagpur court ordered him held without bail for 14 days. As of 26 May, nothing has been said about his release. While he was in prison the police said in a press statement, “The Maoists have themselves given proof of Professor Saibaba’s Maoist links. They dropped some pamphlets near Jambia (Gatta) village condemning the arrest of the professor.” The District Superintendent of Police claimed that this made his links with the CPI(M) “clear”. According to the Hindustan Times, citing government sources, the police planned to oppose his release on bail because an alleged rural confrontation between police and guerrillas proved that he was “dangerous”, because, they claimed, it was “retaliation” for his arrest.
 
Many rights organizations, other groups and intellectuals such as Arundhati Roy have pointed out that with “evidence” like this, the Indian government could arrest anyone they want and hold them indefinitely – which has happened to many activists, charged not for their actions but their alleged associations. They consider Saibaba’s arrest an attempt to intimidate free speech, free association and free thought.
 
Indian and international legal organizations have denounced the Illegal Activities Prevention Act for the vagueness of its definitions of what is illegal and the arbitrariness of the arrests made under its provisions. People have been held for possessing literature of banned organizations. In Saibaba’s case, the authorities are presenting alleged actions by people other than the accused, which even occurred after his arrest, as “evidence” of ties to an organization they decided to outlaw. This whole package of measures makes it legal for the authorities to deny people’s rights whenever they deem it necessary.
 
Saibaba is the joint secretary of the Revolutionary Democratic Front and convener of the Forum against the War on the People, which opposes a government counterinsurgency campaign that has killed thousands of Adavasi (tribal people). He has organized fact-finding missions to look into state violence in rural areas.
 
He has been interrogated four times in the last year. In September 2013 police from Maharashtra raided his Delhi campus residence and seized computer hard drives, reading materials and electronic devices with the pretext of looking for stolen goods. They came back to his home to interrogate him for four or five hours when the charges first surfaced last January. Since then he notified the Nagpur police that he would be available for further questioning at his home or office.
 
In jail, Saibaba has threatened to go on hunger strike because the conditions make it impossible to use the toilet or take care of himself properly.
 
The Delhi Teachers Association released a statement strongly condemning “this arbitrary and illegal action by the police in connivance with the university authorities.” Following the arrest, Saibaba was suspended from his teaching position. Now and on previous occasions when he has faced repression he has had broad support from professors and students.
 
Demonstrations, meetings and other events in support of Saibaba have taken place in Delhi, Kolkota  Bernala,  Hyderabad, Maharashtra and New York.
